IMPORTANT: NFTs are NOT investments. No profit, price appreciation, resale, or lottery win is guaranteed. By participating in the Winfinity ecosystem, you acknowledge and accept all risks described herein.

1. NFTs Are Not Investments

  • Winfinity NFTs are digital collectibles with utility functions โ€” they are NOT investment instruments.
  • Purchasing an NFT does not entitle you to any share of company profits, revenue, or equity.
  • NFT prices can go up or down based on market demand. Past performance of similar NFTs is not indicative of future results.
  • You should never invest money in an NFT that you cannot afford to lose entirely.

2. No Guaranteed Returns or Profit

  • Winfinity makes no representation, warranty, or guarantee that NFT values will increase.
  • There is no guaranteed return on any NFT purchase.
  • No financial advice is provided on this platform. Nothing herein constitutes investment advice.
  • The platform does not act as a financial advisor, broker, or investment manager.

3. No Guaranteed Resale or Liquidity

  • The Winfinity marketplace provides infrastructure for peer-to-peer NFT sales โ€” it does not guarantee any sale.
  • There is no guarantee of liquidity. You may be unable to sell your NFT at any given time.
  • NFT market conditions may change rapidly. Demand for Winfinity NFTs is not guaranteed.
  • Winfinity does not buy back or repurchase NFTs from holders.
  • Any marketplace activity or trading volume mentioned is historical and not indicative of future activity.

4. Lottery Participation Risks

  • Participating in the Winfinity lottery does not guarantee winning a prize.
  • The odds of winning depend on the total number of entries and the weighting applied to your NFT holdings.
  • Lottery mechanics, including point weights, are published and fixed before draw activation but may change in future draw events.
  • Prize amounts depend on total mint revenue and are not guaranteed minimums.
  • The draw is conducted via Chainlink VRF โ€” the outcome is random and cannot be predicted or manipulated.

5. Blockchain and Smart Contract Risks

  • Blockchain transactions are irreversible. Mistakes in wallet addresses or transactions cannot be undone.
  • Smart contracts may contain bugs or vulnerabilities despite auditing. No audit guarantees security.
  • The Polygon network may experience congestion, outages, or other technical issues outside our control.
  • Loss of private keys results in permanent loss of access to your NFTs. Winfinity cannot recover lost wallets.
  • Gas fees fluctuate and are your responsibility. We do not refund gas fees for failed transactions.

6. Regulatory and Legal Risks

  • NFT regulation is evolving globally. Future regulations may affect your ability to hold, trade, or participate.
  • Residents of certain jurisdictions may be restricted from participating. It is your responsibility to understand your local laws.
  • Winfinity may be required to restrict access to participants in specific jurisdictions.
  • Tax treatment of NFT transactions varies by jurisdiction. You are responsible for your own tax obligations.

7. Platform and Operational Risks

  • Winfinity platform rules, features, and mechanics may change over time.
  • The platform may experience downtime, bugs, or service disruptions.
  • Third-party integrations (wallets, marketplaces, blockchain infrastructure) are outside our control.
  • Winfinity reserves the right to modify platform features with reasonable notice to the community.
  • In extreme circumstances, draw schedules may be delayed for technical, legal, or force majeure reasons.

8. Benefits for Non-Winners

  • Non-winning NFT holders retain full ownership of their NFTs after any lottery draw.
  • NFTs retain all ecosystem utility: marketplace listing, future draw eligibility, PimcoAI ecosystem access.
  • The platform actively provides marketplace infrastructure to help holders list and find buyers.
  • Community growth efforts and ecosystem development aim to maintain and grow NFT utility over time.
  • Any growth in NFT utility or value is not guaranteed and depends on ecosystem performance.
